    Four elements of a personal injury claim

    Nevada law requires four elements of negligence to investigate when you (the plaintiff) open a legal claim against the other party (defendant).

    3. Breach of duty: The defendant did not act responsibly in the manner of a reasonable person. That would be considered a breach of duty.
    4. Damages: There has to be substantial economic and non-economic damages sustained to the victim (plaintiff). Property damage, physical injury, and pain and suffering all qualify as damages to a legal claim.

    Establishing these four elements is the cornerstone of a legal claim in a personal injury case. Keep in mind there is a statute of limitation of two years to file a claim, which is why it is best to pursue your options as soon as possible after suffering an injury in an accident.
