Airbnb rentals are a popular option for people who visit Las Vegas and want a home-away-from-home vacation rental. However, Airbnb rentals are not held to the same standards as hotels and resorts in Vegas.
This can result in owners not taking care of their properties to ensure they remain safe for guests. When Airbnb accidents and injuries occur, you need to know your options and how our premises liability injury attorneys can help.

    Airbnb Slip-And-Fall Accident Causes

When you book an Airbnb, you base your decision on online photos, not what you may experience when you get to the rental. Unfortunately, when an owner lets the upkeep of their property slip, there can be several causes for Airbnb slip-and fall-accidents, such as:

    • Uneven flooring
    • Defective stairs
    • Loose or missing handrails
    • Poor lighting
    • Slick floors
    • Leaking appliances
    • Torn carpeting
    • Broken decking
    • Cracked, uneven, or broken pavement/driveway
    • Holes/uneven landscaping

Understanding Premises Liability Coverage And Compensation In Nevada

Premises liability requires property owners to maintain their property in reasonably safe conditions and provide sufficient warnings about any potential hazards on the property. When they fail to do so, they can be held liable for personal injuries that occur on their properties.

After a slip-and-fall accident, Nevada’s premises liability laws require you to prove:

    • There was a dangerous or hazardous condition on the property
    • The owner knew about the danger or hazard or should have known about it
    • The dangerous or hazardous conditions were the cause of your injuries

Who Can Be Held Liable For A Slip And Fall At An Airbnb?

Usually, Airbnb hosts are held liable for slip-and-fall accidents when they are aware of an existing dangerous or hazardous situation but do nothing to resolve it. However, in some situations, other parties could be potentially liable.

For example, the property owner uses a cleaning company to clean the home after guests check out. The cleaning company over-waxed the floors, making them extremely slippery. Since their actions created a hazardous situation, the cleaning company could also be liable.

    Airbnb’s Host Liability Insurance

When slip-and-fall accidents occur, you normally file your claim against the owner’s Airbnb host liability insurance. Host liability insurance provides up to $1 million in liability coverage per occurrence at the host’s rental property. This insurance covers condos, townhomes, houses, and mobile homes, as well as non-traditional rental accommodations, such as RVs and houseboats.

However, there are some expectations where Airbnb host liability insurance will not cover a guest’s injuries. In these situations, you would file your injury claim against the host’s personal homeowner’s insurance.

What Is The Deadline For Filing A Slip-And-Fall Lawsuit?

The deadline for filing an Airbnb slip-and-fall lawsuit is two years, as detailed in NRS 11.190(4). The clock starts counting down from the accident date or when you have reasonably discovered your injuries.

The longer you wait to file your premises liability claim, the more difficult it is to prove the host was negligent. Evidence can get lost and destroyed, or the dangerous or hazardous condition can be fixed and resolved.

There are a few exceptions to the two-year filing deadline. For example, a minor was the one injured. While their parents could initiate the injury claim immediately, the minor has two years from the time they turn 18.

What Should I Do When I’m Injured At An Airbnb?

If you are injured at an Airbnb, there are specific steps you should follow to protect your right to file an injury claim against the owner.

    1. Seek Medical Treatment

In order to have a premises liability claim, the slip-and-fall accident must have resulted in personal injuries. Seeking medical treatment is necessary to document your injuries, even if they are only minor.

    2. Gather Evidence

You must gather evidence to support your injury claim and prove the host was negligent. You should take pictures and videos of where the accident took place that show the unsafe, dangerous, or hazardous conditions.

    3. Notify The Owner

You should notify the owner that you were injured in their home. Only provide the facts of what occurred and never admit you were at fault. For example, on Friday afternoon, at 2:13 p.m., you tripped over a broken deck board, fell down the deck’s stairs, broke your arm, and had several cuts, scraps, and bruises.

    4. Consult With A Las Vegas Personal Injury Lawyer

Before filing a claim with the host’s Airbnb liability insurance, it is worth your time to schedule a free consultation with one of our Las Vegas personal injury lawyers. During your consultation, you will find out how best to proceed with your injury claim.

Airbnb’s insurance company will want to settle for the least amount possible quickly. Having legal representation ensures you receive the compensation you are entitled to and that your settlement covers all of your injuries and losses.

    5. File A Claim With The Host’s Airbnb Liability Insurance

Your premises liability attorney will file the claim with the host’s Airbnb liability insurance. They will handle all negotiations and discovery sessions and advise you once you have received a fair settlement offer.
