Las Vegas Car Accident Lawyer

After being involved in a car accident in Las Vegas where you or a loved one sustains injuries, it is beneficial to get help from one of our experienced auto accident lawyers. Navigating the complexities of filing insurance claims and negotiating a fair settlement can be stressful and increase your anxiety while you are trying to heal and recover from your injuries. Let the experienced legal team at Adam S. Kutner, Injury Attorneys, represent your interests to secure the compensation you deserve.

Our Auto Accident Case Results

One of the reasons we are Las Vegas’ best accident lawyers is our commitment and dedication to our clients in obtaining favorable case results. We have helped numerous clients secure compensation for their current and future losses, including property damage.

The amount of money you can get from a car accident settlement depends on the extent of your injuries and their impacts on your life. Equally important is the degree of fault you contributed toward the accident. In Nevada, you can still seek compensation, even when you are partially at fault. Additionally, the settlement amount will vary based on what insurance coverages you and the other driver have in effect at the time of the accident.

Keeping these things in mind, average car accident settlements are around $15,443 when there are physical injuries and around $3,231 when there is only property damage. Our law firm has negotiated settlements ranging from several thousands of dollars to millions of dollars. Again, it will depend on the specifics of your situation and the extent of your injuries as to how much you could receive for your settlement.

Financial Compensation You Can Recover After an Auto Accident

The financial impacts of an auto accident can include both economic losses and non-economic losses. Economic losses include anything with an actual dollar value, while non-economic losses cover things you cannot assign a specific dollar amount. Both types of losses include:

  • Medical bills
  • Rehabilitation costs
  • Prescription medications
  • Mental health counseling and treatment
  • Present and future lost wages
  • Financial impacts to address physical accommodation needs
  • Loss of benefits from not being able to work
  • Pain and suffering
  • Emotional anguish
  • Loss of consortium
  • Loss of companionship
  • Property damages

The specific types of losses you can recover will be directly related to your injuries and property damage sustained during the car accident.

In addition, punitive damages may be awarded in cases where the other driver displayed extreme recklessness, such as driving under the influence, driving recklessly, or intentionally wanting to harm others. Punitive damages are awarded by a judge as a means to punish the defendant and act as a deterrent to prevent others from behaving in a similar manner.

Why Should I Hire a Car Accident Lawyer?

Being involved in a car accident where you are injured quickly changes your life. You have to be in the hospital, worry about missing work, try to deal with filing insurance claims, and potentially be taken advantage of by the insurance companies. Hiring a car accident lawyer in Las Vegas takes all the added stress and anxiety away and provides you with several benefits to help ensure you get the best settlement possible, including:

  • Legal expertise: You have direct access to a car accident lawyer who understands both sides of the insurance claims and settlement processes. This knowledge helps you receive maximum compensation.
  • Gathering evidence: From the moment of your accident, all sorts of evidence have to be gathered to support your claim and prove the other driver was negligent. Your lawyer and their legal team get to work right away gathering evidence, such as traffic camera footage, tracking down witnesses, obtaining the police report, getting copies of your medical records, and getting pictures of the accident scene. You never want to delay gathering evidence as it could disappear or become more challenging to obtain.
  • Providing an accurate assessment of your compensation: Your lawyer knows how to correctly value your losses to give you an estimate of the amount of compensation you could receive.
  • Negotiating with the insurance companies: Your lawyer acts on your behalf to negotiate a favorable settlement with the insurance companies. Since insurance companies and insurance adjusters have their own legal teams, it is vital to have a lawyer on your side. Otherwise, you will not get a fair settlement.
  • Filing your car accident injury lawsuit: Filing a car accident injury claim will involve filing a lawsuit against the responsible party and their insurance company. The lawsuit needs to be filed early as this puts the insurance company on notice that you are serious about receiving a favorable settlement offer.
  • Taking your case to trial: If needed, your lawyer will litigate your case in court should it proceed to trial. They will also call on witnesses who saw the accident, as well as experts, such as accident reconstructionists, medical doctors, and other professionals, to further substantiate and prove the other party was negligent.
  • Preventing you from hurting your claim: Insurance companies and adjusters will use various tactics to devalue your claim or even attempt to deny it. Without legal representation, they will ask you leading questions and then take your responses and use them against you. This is also why you should never speak to an insurance adjuster directly on your own.

Why Choose Our Auto Accident Law Firm?

Adam S. Kutner has over 33 years of experience helping people receive fair compensation and favorable settlements after a car accident. Our auto accident law firm puts the needs of our clients first and foremost. We are not afraid to litigate your case at trial if necessary. Our dedication and commitment to our clients have also earned us the reputation of Las Vegas’ best accident lawyers.

Without legal representation, you are left to deal with the defendant, their insurance company, and insurance adjusters. The defendant could claim they are not at fault. Their insurance company and adjusters will downplay the seriousness of your injuries. Furthermore, they will use tactics like telling you this is the best settlement offer you will get even if you hire our auto accident law firm.

It is vital to remember these are just ploys they use to get you to settle for the least amount possible. You have the legal right to consult with an attorney to obtain legal information, find out the actual value of your claim, and have your questions answered honestly. At Adam S. Kutner, Injury Attorneys, we are fully committed to ensuring you get the settlement you deserve, no matter how severe your injuries. We will also help family members recover compensation after the wrongful death of a loved one from a car crash.

Most Common Types of Car Accidents in Las Vegas

Car accidents occur in Las Vegas daily due to the heavy traffic congestion from locals and tourists. Some of the more common types of accidents include:

  • Rear end collisions
  • Side-impacts and T-bone crashes
  • Sideswipes
  • Rollovers
  • Head-on collisions
  • Parking lot collisions
  • Pedestrian and bicycle crashes
  • Motorcycle collisions

No matter what type of car crash you are involved in, you need help from our Las Vegas car accident attorneys anytime you or your loved ones are injured. Our law firm is also available to provide a free consultation if you have questions about minor injuries and property damages.

How Long Do I Have to File a Car Accident Injury Claim in Las Vegas?

Car accident injury claims must be filed within two years from the date of the accident based on the legal requirements of Nevada Revised Statute 11.190. Even though you have up to two years, filing your injury claim as soon as possible is highly recommended. You want to ensure your lawyer is able to gather sufficient evidence to support your injury claim and prove the other party was at fault.

How Is Fault Determined in Nevada Car Accidents?

Nevada uses an at-fault system to determine who is at fault in an accident and who is responsible for paying damages to the appropriate parties. In cases where one driver is entirely at fault, the plaintiff (injured party) will file an injury claim against the defendant’s insurance company.

If they lack sufficient insurance coverage, the plaintiff can sue them directly in civil court. The plaintiff can also file a claim against their insurance if they have underinsured coverage.

In cases where both parties are considered partially at fault, Nevada uses a modified comparative negligence system, as detailed in Nevada Revised Statute 41.141. The law allows people to seek compensation when they are partially at fault. However, they must be less than 50% at fault to still be able to file an injury claim against the other party.

How settlements work under a modified comparative negligence system is the total amount is reduced by the percentage you are found to be at fault. For example, if you are found to be 25% at fault, and the total settlement is $100,000, you would receive $75,000 as your final settlement amount.

Fault can also be split between parties when more than one party is at fault. For example, you are rear-ended by one driver. Then another driver rear-ends them, and the force of the impact propels your car into an intersection where it is hit again. The fault could be divided between the first and second drivers since they both contributed to your injuries.

What Our Clients Say

Frequently Asked Questions After an Auto Accident

What Steps Should I Take After a Las Vegas Car Accident?

To protect your legal rights to file an injury claim, there are specific steps to follow after a car accident in Las Vegas as follows:

  • Call 911: It is important to call the police and obtain a police report. You should also request medical assistance for any injuries, no matter how minor they appear. Sometimes, injuries can be more severe due to internal injuries that are not always apparent.
  • Seek medical care and treatment: You should obtain medical care and treatment for your injuries as soon as possible. Your health and well-being should be your top priority.
  • Do not admit fault: When speaking to the police, state the facts without admitting fault, even if you believe you could be partially at fault. While police reports cannot be used as evidence against you in court, insurance companies may still attempt to use anything you say against you when negotiating a settlement.
  • Obtain evidence: If possible, take pictures of the accident scene, including damages to all vehicles involved and your injuries. You should attempt to obtain contact details for any witnesses. Look around for traffic cameras or other video cameras on nearby businesses facing the street and take note of these. You will also want to get the other driver’s contact information and insurance information.
  • Notify your insurance company: You should contact your insurance company and inform them of the accident. Stick to the facts and only provide basic details, like when the accident occurred, where it occurred, and the other driver’s details and insurance provider.
  • Schedule a consultation with our auto accident lawyer: Before making any statements to the insurance companies, you will want to speak to one of our auto accident lawyers. If you are hospitalized, we will come to you for your consultation. Seeking legal advice will help you determine your next steps, the value of your claim, and how our law firm can help you obtain the compensation you deserve.

Do Most Auto Accident Cases Go to Court?

The vast majority of auto accident cases are settled before they even go to trial. Insurance companies do not want the negative publicity and added costs of trial, so they are more willing to reach a settlement and resolve the matter out of court.

Even in cases where a settlement cannot be reached and the case goes to trial, insurance companies will still often attempt to settle the matter before a verdict is reached. They do not want to risk the judge or jury awarding high compensation when the evidence is not in their favor.

Where Do I File a Police Report in Las Vegas?

When the police respond to a car accident in Las Vegas, they will usually file the police report for you. However, you do need to verify they included all the required information as listed in Nevada Revised Statute 484E.070

Nevada law requires you to file a police report when:

  • The property damages are more than $750
  • Anyone involved in the accident was injured
  • Anyone involved in the accident died

You have ten days from the date of the accident to file a police report. You can file the report online, in person, or over the phone with the appropriate police jurisdiction. For example, if a car crash occurred within Las Vegas City limits, you would file a report with the Las Vegas Metro Police. If the accident occurred in another jurisdiction, then you need to file the report with that police agency.

You also need to attach specific documentation to the report, including repair estimates for property damages and medical statements from doctors for anyone who was injured in the accident or who died.

Our Las Vegas car accident attorneys can assist you in ensuring your police report is filed within the mandatory ten-day period when you contact us immediately following your car accident and hire us to represent your interests.

How Do I Negotiate My Insurance Accident Case?

One of the biggest mistakes people make is attempting to negotiate their insurance accident case without legal representation. Insurance companies and adjusters have access to their own legal team. They know how to use different tactics to devalue your claim and can even attempt to deny it.

They also will make it sound like they care about you and your injuries. They may state they want to get this resolved as quickly as possible. However, their initial offers are rarely the actual compensation you should receive.

It is vital to remember insurance companies are for-profit businesses. The last thing they want to do is pay out large settlements when they can get you to settle on your own without help from a lawyer. They may also use “scare tactics” where they will say this is the best offer you are going to get, or if you don’t settle for what they are offering, they are going to lower it even more.

Do not fall prey to these tactics. If you initially started negotiating your claim on your own, there is still time to get sound legal advice from our car accident law firm. Until you consult with our lawyers, never, under any circumstances, agree to a settlement offer or sign any paperwork the insurance provides.

You could inadvertently be signing a settlement agreement and not realize it. Once you sign a settlement agreement, you cannot seek further compensation, even when you were legally entitled to a higher amount to begin with.

What Is the Average Auto Accident Claim Timeline?

The average auto accident claim timeline generally ranges between a month to six months. However, more complex cases, where injuries were more severe or there was a wrongful death, could take between six months and a year to settle in most cases. Our car accident attorneys work aggressively to help car accident victims receive fair compensation as quickly as possible.
